Terms of Service

These Terms of Service (“Terms”) govern your access to and use of ZAYNEXA GAME mobile applications (“Apps”) and website (“Site”). By accessing or using our Apps or Site, you agree to these Terms. If you do not agree, do not use the Apps or Site.

Important: Our games are provided “as is.” We limit liability to the maximum extent permitted by law. Please review sections on Purchases, Disclaimers, and Limitation of Liability.

1. Who We Are

“ZAYNEXA GAME”, “we”, “our”, or “us” refers to the independent developer/studio operating the Apps and Site. Contact email: zaynexagame@gmail.com.

2. Eligibility & Use

You must comply with applicable laws and platform rules (including Google Play policies). If you are under the age required to consent to these Terms in your country, you must have a parent/guardian’s permission.

3. License (Permission to Use)

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Apps for your personal, non-commercial entertainment purposes, and to access the Site, subject to these Terms.

4. Prohibited Conduct

You agree not to:

  • Cheat, exploit bugs, or use unauthorized scripts/bots/mods to gain unfair advantage
  • Reverse engineer, decompile, or attempt to extract source code except where the law allows it
  • Interfere with servers, security, or integrity of the Apps/Site
  • Use the Apps/Site for illegal, harmful, or abusive purposes
  • Upload or transmit malware or harmful code
  • Infringe our intellectual property rights or the rights of others

We may suspend or terminate access if we reasonably believe you violated these Terms, engaged in fraud, or harmed other users or the service.

5. Accounts & Progress (If Applicable)

Our Apps may store progress locally on your device and/or via third-party platform services. If you uninstall the app, reset device data, or switch devices, progress may be lost unless a supported restore method exists. We do not guarantee restoration of progress in every scenario.

6. Virtual Items, Rewards & Game Economy

The Apps may include virtual currency, rewards, consumables, non-consumables, subscriptions, themes, boosters, or other virtual items (“Virtual Items”). Virtual Items have no real-world monetary value and cannot be exchanged for cash (unless required by law).

  • We may modify, rebalance, add, or remove Virtual Items to maintain fair gameplay and performance.
  • Rewards and event features may be time-limited and can change or end without notice.
  • We may adjust drop rates, prices, bonuses, or mechanics to improve the experience.

7. In-App Purchases & Subscriptions

Purchases are processed by the platform (e.g., Google Play). You agree that:

  • All billing, refunds, and chargebacks are handled according to the platform’s terms and policies.
  • We do not store your payment card details.
  • Digital purchases may be non-refundable except where the platform or applicable law requires otherwise.

7.1 Subscriptions

If the App offers subscriptions, they may renew automatically unless canceled through your store account settings. Subscription benefits may change over time (with reasonable notice where required).

7.2 Fraud & Abuse

We may revoke access to premium content or Virtual Items if we detect fraudulent purchases, chargebacks, or abuse, consistent with applicable law and platform rules.

8. Advertising

The Apps may display advertisements (e.g., AdMob). Ad availability, frequency, and format may vary by region, device, gameplay, and settings. Ads are provided by third-party networks and may be subject to their policies.

9. User Feedback & Suggestions

If you submit feedback, suggestions, ideas, or content (“Feedback”), you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate that Feedback into our products without compensation, unless prohibited by law.

10. Intellectual Property

The Apps, Site, and all related content (graphics, logos, UI, game design, code, audio, text, and trademarks) are owned by ZAYNEXA GAME or licensors and are protected by intellectual property laws. You may not copy, distribute, sell, or create derivative works except as permitted by these Terms or by law.

11. Third-Party Services & Links

The Apps/Site may include third-party services (Google Play, AdMob, analytics tools) or links to third-party sites. We do not control those services and are not responsible for their content, policies, or practices. Your use of third-party services is subject to their terms.

12. Updates, Availability & Changes

We may update the Apps to add features, fix bugs, improve performance, or comply with legal requirements. We do not guarantee continuous availability of any feature, event, or content. We may modify or discontinue the Apps or Site (in whole or in part) at any time, subject to applicable law.

13. Disclaimer of Warranties

To the maximum extent permitted by law, the Apps and Site are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

  • We do not guarantee that the Apps/Site will be uninterrupted, error-free, or secure.
  • We do not guarantee that gameplay progress or Virtual Items will always be recoverable.
  • We do not guarantee compatibility with every device or OS version.

14. Limitation of Liability

To the maximum extent permitted by law, ZAYNEXA GAME and its affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or gameplay progress, arising out of or related to your use of the Apps or Site.

Where liability cannot be excluded, our total liability will be limited to the amount you paid (if any) for the App or relevant in-app purchase in the period allowed by applicable law, or the minimum amount required by law.

15. Indemnification

You agree to indemnify and hold harmless ZAYNEXA GAME from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your violation of these Terms
  • Your misuse of the Apps/Site
  • Your violation of laws or third-party rights

16. Termination

We may suspend or terminate your access to the Apps or Site at any time if you violate these Terms, engage in fraud, or if required to protect our services or users. You may stop using the Apps at any time by uninstalling. Sections intended to survive termination (including IP, disclaimers, limitation of liability) will survive.

17. Governing Law & Disputes

These Terms are governed by the laws applicable in your jurisdiction and/or where our business is based, without regard to conflict of laws rules, except where mandatory consumer protection laws apply.

If you are a consumer, you may have mandatory rights in your country that cannot be waived. Nothing in these Terms limits those rights.

18. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised “Last updated” date. Your continued use of the Apps/Site after changes means you accept the updated Terms, to the extent permitted by law.
